Sir,

I am directed to thank you for your communication of the 15th instant anent the case of the Captain of the S.S. "Wingchai" who was fined in the Marine Court at Hong Kong for obstruction on the high seas and wilful disregard of the Rules of the Road.

The Guild much regret that the Secretary of State for the Colonial cannot render assistance owing to the impossibility of his interfering with the decision of a magistrate. The resort which you point out in appealing to the Supreme Court of the Colony is one surrounded by many difficulties. The Captain would in all probability require to give up his command, at least temporarily, and the additional trouble and expense caused him would be very great.

The Guild are strongly of opinion, and the principle has been accepted by several Government departments, that it is an injustice that Captains and Officers of merchant ships should be judged solely by Officers of the Royal Navy who have laboured

in an entirely different sphere and are quite unacquainted with the systems and procedure of the merchant service or of the multifarious difficulties under which the executive Officers of it labour.

Though the Secretary of State for the Colonies is unable to interfere with the decision which has been submitted to him, the Guild earnestly trust that he will use his powerful influence in ensuring
